Eride Technologies – Terms of Use

1. Introduction

Welcome to Eride Technologies (“we”, “us”, or “our”). We provide two primary services:

  1. AI Travel Assistant for SADC Travellers – A digital platform offering travel assistance, information, itinerary planning, and advisory services for travellers within the Southern African Development Community (SADC) region.

  2. DHA Vlist-Assist: South Africa Visa Overstay Appeal System – A platform designed to assist individuals in managing, preparing, and submitting appeals relating to visa overstay listings with the South African Department of Home Affairs (DHA).

By accessing, using, or interacting with any of our services, applications, websites, or platforms (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, you must discontinue using our Services immediately.

2. Eligibility

You may only use our Services if you:

  • Are at least 18 years old (or the age of majority in your jurisdiction).

  • Have the legal capacity to enter into binding agreements.

  • Comply with all applicable laws and regulations in your jurisdiction.

3. Nature of Services

  • An immigration officer or legal representative (unless otherwise stated in specific partnerships).

  • A travel agent in the traditional sense (unless expressly stated).

While we strive for accuracy, our Services do not guarantee the approval of travel itineraries, visas, or appeal outcomes.

4. User Responsibilities

  • Provide accurate, truthful, and up-to-date information when using our Services.

  • Not use our Services for any unlawful, fraudulent, or malicious activity.

  • Keep your account login credentials secure and confidential.

  • Accept full responsibility for actions taken under your account.

5. Data Collection and Privacy

Your use of our Services is subject to our Privacy Policy, which explains how we collect, process, store, and protect your personal information in compliance with POPIA.

You consent to our use of your data to:

  • Provide and improve Services.

  • Facilitate travel planning and visa-related appeals.

  • Communicate with you regarding your queries, applications, and updates.

6. Service Limitations

While we use reasonable efforts to ensure accuracy and availability, you understand that:

  • Information may be based on third-party sources (e.g., DHA guidelines, airline schedules, travel advisories).

  • We are not responsible for errors, delays, or service interruptions beyond our control.

  • The DHA Vlist-Assist tool does not guarantee the outcome of any appeal.

7. Intellectual Property

All content, trademarks, software, and materials provided through our Services are the exclusive property of Eride Technologies or our licensors, unless otherwise stated.

You may not:

  • Copy, modify, reproduce, distribute, or create derivative works without prior written consent.

  • Reverse-engineer or attempt to extract source code from our systems.

8. Third-Party Services

Our Services may link to or integrate with third-party platforms (e.g., government portals, travel providers).

We are not responsible for:

  • The content, accuracy, or availability of third-party sites.

  • Any damage or loss resulting from your use of third-party services.

9. Disclaimers

Our Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

We disclaim any responsibility for:

  • Losses incurred from relying on our recommendations.

  • Travel disruptions, visa denials, or appeal rejections.

  • Technical issues, data loss, or unauthorised access.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Eride Technologies, its directors, employees, and affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of our Services.

  • Our maximum aggregate liability will not exceed the amount paid by you for the specific service in question.

11. Indemnification

You agree to indemnify and hold harmless Eride Technologies from any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from your:

  • Breach of these Terms.

  • Misuse of our Services.

  • Violation of applicable laws.

12. Termination

We may suspend or terminate your access to our Services at any time, without notice, if you:

  • Breach these Terms.

  • Misuse or abuse our Services.

  • Engage in fraudulent or unlawful activity.

Upon termination, your right to use the Services will immediately cease.
